Hotties Terms
These terms and conditions apply to the contractual relationships between Hotties and its members (those who use the website hotties.co.za). Hotties is operated by HOTTIES ONLINE (PTY) LTD which is referred hereafter sometimes as “Hotties” or “Hotties.co.za”
Hotties.co.za can only be used if you are 18 and above, and for non-commercial purposes. Hotties is a location-based social platform that facilitates communication between mutually interested members, allowing matched users to chat.
Binding Agreement
This Agreement is an electronic contract that sets out the legally binding terms. You must accept this Agreement to use the Website and to become a “Member.” For purposes of this Agreement, the term “Member” or “Membership” means a person who provides information to Hotties.co.za to participate in the Service in any manner, whether such person uses the Service as a free Member or as a paid subscriber. This Agreement may be modified by HOTTIES ONLINE (PTY) LTD in its sole discretion at any time, and any such modifications will be posted on the website. Your continued use of the hotties.co.za or the Service after the posting of modifications to this Agreement will constitute your acceptance of such revisions.
The service provided by Hotties gives you access to an online database during the term of the contract, through which you can get to know other registered members through services that are both free and subject to a fee. Hotties services are only via the Internet on the website hotties.co.za
With Hotties’ community, registered members can get in contact with other people for dating purposes and finding new friends.
HOTTIES ONLINE (PTY) LTD is not a marriage broker and does not owe a user marriage brokerage, initiation or hooking up with somebody.
Termination
This agreement will stay always in full force while you use our website (hotties.co.za). You can end your membership at any time and for any reason by following the instructions on the “Membership cancel” section on the website. Hotties also can end your membership at any time without prior notice. If Hotties terminates your membership you are not entitled for any refund or of the subscription fees. Your membership can be ended for any reason. These terms are still applicable after termination of your Membership.
Exclusively for Non-Commercial Use
You CANNOT use hotties.co.za or the Service for business or media purposes. Illegal and/or unauthorised use of the Website or Service will be investigated, and we will take legal action. We may refer activities we deem suspicious to government authorities.
Chargeable and Free of Charge Services
With a free membership (also called Hottie). The membership is only available for women.
PREMIUM, this is a paid premium memberships for men. Details on this membership are stated prior purchase.
Hotties has an annual availability of 99%. Downtimes that occur due to maintenance and / or due to software updates are excluded. Excluded as well are times when the service is not available on the Internet due to technical or other problems that are not within Hotties’ sphere of influence. A prerequisite for full use of the Hotties services is the use of the latest (browser) technologies, including the activation of, for example, Java Script, cookies, pop-ups, etc.
Liability Notice
We are not responsible for incorrect information within the registration or the profile information of members. We can therefore not guarantee the accuracy of the compatibility between matches.
Nor can we guarantee any success in mediation. Hotties only provides the customer with IT services or technical infrastructure for the automatic mediation of contacts.
In the event that members misuse the services of Hotties in an unauthorised or illegal manner, Hotties assumes no liability. Hotties cannot be held responsible for the misuse of information; especially not if the member has made the information accessible to a third party.
Hotties does not guarantee uninterrupted operation or the correct use or accessibility of the service at any time. In particular, Hotties is not liable if there are disruptions due to force majeure or events that are beyond Hotties’ sphere of influence. In addition, Hotties is not liable in the event that third parties gain unauthorized knowledge of a customer’s personal data (e.g. through a “hacking attack”).
Customer’s Duties
The use of Hotties’ services forbids any use of the site what is violating any legal law, code of ethics, and good citizen behavior. This includes but is not limited to crimes, fraud, escorting, prostitution, human trafficking.
The customer is obliged to make all payments due to Hotties on time. If the customer is culpably in arrears with more than one successive installments, all outstanding payment claims up to the end of the term are due immediately.
When registering, it is your responsibility to provide truthful information. The customer is solely responsible for the content of her\his personal data and assures the accuracy of the information. Hotties reserves the right to take civil action against customers who intentionally and or fraudulently provide false information.
Hotties services are intended for private use only. By registering, you undertake not to use Hotties services for commercial purposes and not to use data made available to you for commercial or advertising purposes. You are expressly not permitted to systematically collect the content of other users (e.g. through a special program or by simply copying the data) and to use it for purposes other than the service of Hotties. In this context, it is particularly not permitted to use computer programs such as Crawlers to use to read other customers’ data.
If you acted culpably, you are obliged to indemnify Hotties against any kind of lawsuits, damages, losses or claims that could arise from your registration and / or participation in our service. This applies in particular to damage due to defamation, insult, violation of personal rights, the loss of services for other members, a violation of these terms and conditions, the violation of intellectual property or other rights. The amount of the claim for reimbursement of expenses is limited to the expenditure required or required for a specific purpose.
It is your responsibility to keep emails and other messages from other Hotties members confidential and not to make them accessible to third parties without the consent of their author. The same applies to the names, cellphone numbers, email and residential addresses, social media profiles and / or URLs or other personal data etc. of our members.
You are also required to treat the information shared through the video feature confidential and with respect. This means, you are not about to share personal WhatsApp or Instagram account information without the other person’s consent. When using chat features on third party apps, you are required to behave in a respectful and polite way. Misuse of this service will be prosecuted. You are solely responsible for sharing your own social media account, or phone number and your are also responsible for the content you share in picture, word or text form while doing on our platform or any third party application.
Hotties is entitled to delete messages without asking at any time. All data in the context of a free membership can be deleted 2 months after the last login by the member. For this reason, you are requested to call up the incoming messages and the data of your profile at regular and appropriate intervals and to archive them on your own computer or other storage media if necessary.
You further undertake not to misuse the service, in particular:
Not to distribute immoral, obscene, pornographic or radical political content or photos;
to disseminate any defamatory, objectionable or otherwise illegal material or such information via the service;
not to threaten, harass or violate any other person’s rights (including personal rights);
not upload any data that contains a virus (infected software) or software or other material that is protected by copyright, unless the customer has the rights to it or the required consent;
not to use the service in a way that adversely affects the availability of offers for other customers;
not to intercept emails / messages and not to try to intercept them;
Sending emails / messages to customers for no other purpose than communication and in particular refraining from offering or offering goods or services to other customers (except in cases where this is expressly permitted by Hotties);
no chain letters to send;
not to send messages that serve a commercial purpose;
not to upload photos with text, advertisement or photos that are screenshots;
not to upload photos what are regarded sexual, explicit, harassing etc:
not to mention names, addresses, telephone numbers, email addresses, social media accounts or payment accounts etc. in the personal description. In free contact inquiries this applies to the fact if this information is expressly required.
Failure to comply with one of the behavioral obligations mentioned above can lead to the following sanctions without prior warning:
Request for comments in the event of suspected breach of contract / law,
blocking of use up to the clarification of facts (especially in the case of several complaints from other members),
permanent removal and loss of use of the Hotties platform,
warning, input / restrictions on the use of applications in Hotties’ services,
partial and total deletion of your content.
Failure to comply with the duties of conduct mentioned in section can always lead to an immediate termination of the user agreement as well as civil and criminal consequences for you. Blocking your access to the Hotties platform does not change the payment obligation for services ordered.
Reasonable Use of Hotties Services
You as a user are solely responsible for the content, information, and any other service the you post, share, link, publish or transmit in any other form to people on the Hotties platform and to the Hotties staff. You are not allowed to post on the Hotties website or share to anyone any content or interact through the Hotties platform:
In a manner that objectifies other users and/ or reduces them to material value
In abusive ways
In violation of any law, code of ethics, code of moral, regulation or in violation to the Hotties guidelines.
In a manner that violates and infringes intellectual property rights, personal rights and any copyrights, trademarks, privacy or publicity rights of others
In a manner that is offensive, abusive, threatening, hateful or intimidating to other Hotties members with the use of multiple accounts for one user
It is prohibited that a person is violating or trying to breach the security of the website this includes:
investigating, scanning the system and network of its technical functions, engineering and coding
Accessing data that is not intended for public use or accessing accounts that belong to other Hotties member and all accounts that are not meant to be accessed by you
Violate security authentication barriers in particular the face identity check or income verification check
Harming the platform by sharing/ uploading viruses, sending mail bombs, flooding the system or trying to crash it
Sending Hotties unsolicited emails not being connected with our core product that includes shady business/ service advertisements
Forging pictures or photoshopping them and other documents in order to disguise the true identity and nature
Sending links which lead to explicit content or sites which contradict a genuine dating experience
Misusing the platform for adultery and any other kinds of sexual-related purposes or non-genuine dating and connecting.
The further use of Hotties remains prohibited at all times:
Posting any incomplete, false, misleading, or inaccurate content about yourself and/or your profile;
Posting any content that is objectionable, reduces the dignity of people and/ or is abusive and harms other people;
Impersonating, or otherwise misrepresenting an affiliation, connection or association with, any person or entity;
Posting advertisements or solicitations of employment, business,
Using the Hotties.co.za services for activities that violate any law, statute, ordinance, or regulations;
Using the hotties.co.za services to encourage, promote, facilitate, or instruct others to engage in illegal activity;
Engage in any activity that violates criminal laws of the jurisdiction in which the member resides, visits or contacts members;
Stalking or otherwise harassing any other members;
Recruiting for pornography, escort sites, brothels or other morally objectionable business.
Hotties is an online service. As such, Hotties communicates with its customers either via the in-app messenger system when logged in or via email (e.g. support, sending partner proposals, contract confirmation and invoices / reminders).
Rights of Use and Copyrights
In relation to you, Hotties is the sole legal owner of the reproduction, distribution, processing and all copyrights as well as the right of intangible transmission and reproduction of the Hotties website and the individual content contained therein. The use of all programs and the content, materials, brand and trade names contained therein is only permitted for the purposes stated in these terms and conditions.
Subscriptions and Memberships
Hotties provides automatic renewal options when purchasing a premium membership of Premium or Hotties. This option is voluntarily. If a user chooses the automatic renewal option when purchasing, Hotties will renew all paid subscriptions on the date when the initial membership is expiring. After the first subscription period, the membership will renew for another period as stated on the check out process. Then the subscription is going to renew automatically for every ongoing subscription period. When purchasing an auto renewal membership, the Hotties user confirms that the account will be subject to the renewal plan. If a member does not want the account to renew the paid membership anymore.
When you deactivate or delete your membership account, or if the account is suspended for violating Hotties terms, rules or guidelines, you acknowledge that any remaining or unused membership and no refunds will be issued for any remaining subscriptions . If you deactivate your account and will reactivate it later, you further agree that any remaining subscriptions at the time of the account deactivation will not be reinstated and can be lost.
Customer Privacy policy
Hotties Online (Pty) Ltd shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal
information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted
Payment may be made via Visa, MasterCard and American Express
Card acquiring and security
Card transactions will be acquired for Hotties Online (Pty) Ltd via Paystack. Paystack uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to Paystack to view their security certificate and security policy.
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
Country of domicile
This website is governed by the laws of South Africa and Hotties Online Pty Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.
Variation
Hotties Online (Pty) Ltd may, in its sole discretion, change this agreement or any part thereof at any time without notice.
